Terms and Conditions – Cashback
1. This offer entitles the end user to cashback on their Bank Account or UPI. The customer will be responsible for their choice of the cashback transfer method. The denomination of the cashback will be mentioned on the voucher/scratch card.
2. Any consumer purchasing a promotional product shall be eligible to receive a Voucher. The customer shall receive a cashback of an amount equivalent to the value as mentioned in the Voucher (“Cashback/Voucher Amount”).
3. By redeeming the Offer provided on the same, a participant agrees to be bound by the terms and conditions below (“Conditions”).
4. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt Ltd. No claim shall lie for any redemption requests made after the expiry of the Offer Period.
5. The customer will be responsible for entering details such as UPI ID, Account No, etc. Premier Sales Promotions Pvt Ltd. will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the booking.
6. The Cashback Processing Partner holds the right to refuse transactions deemed fraudulent as per their policies. In the event of any fraud detection, the Cashback Processing Partner reserves the right to modify/change, discontinue, terminate, or withdraw the Offer at any time during the Offer Period.
7. In no event shall Premier Sales Promotions Pvt Ltd or John Distilleries Pvt Ltd be held liable for any issues relating to the redemption of the voucher including redemption requests not being honoured by the Cashback Processing Partner.
8. In no event shall the maximum liability of Premier Sales Promotions Pvt Ltd exceed the value of the voucher as the case may be.
9. Any disputes or differences in connection with the offer shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Courts at Bangalore.
10. The Cashback Processing Partner reserves the right to restrict cashback for any account with suspicious behaviour or invalid details/credentials. The Cashback Processing Partner has the right to ask for documents to prove the customer/user's identity.
11. This offer is subject to promotional availability.
12. Cashback Scheme (Vendor Agreement): The cashback scheme is being managed by Premier Sales Promotions Pvt Ltd, for which John Distilleries Pvt Ltd (JDPL) will pay an agreed, all-inclusive price per bottle sold under the promotion. Since the vendor is responsible for all associated activities, JDPL must deduct Tax Deducted at Source (TDS) at the rate of 2% under section 194C on the total consideration payable to the vendor, as per the relevant provisions.
General Terms & Conditions
1. This Voucher entitles you to an assured cashback of Rs. 500 (assured cashback of Rs. 50). The value of the cashback won will be mentioned post registration of your voucher on the promotional website.
2. This offer is not available to employees / trade partners of John Distilleries Pvt Ltd and Premier Sales Promotions Pvt Ltd, its clients or agencies and their immediate families.
3. The usage of this Voucher is incumbent upon the terms & conditions to be followed by the voucher holder/purchaser. Such conditions need to be followed by the voucher holder/purchaser.
4. The "How to Use/Redeem" instructions form a part of these Terms & Conditions.
5. The Promotion & contest shall run on the 750 ml SKU only.
6. Offer excludes Public Holidays and bank holidays.
7. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant. Also, regular call and message rates will apply as per the consumer telecom operator in their respective circles.
8. Only one voucher code per booking will be entertained. Multiple vouchers cannot be booked together.
9.A maximum of one voucher can be used per person, per mobile number, per email id, per account /UPI Id per fortnight (Maximum of 4 in the entire campaign duration)  vouchers during the promotion period.

11. Premier Sales Promotions Pvt Ltd is acting as an executing agency for this promotional offer and holds no legal and financial liability on unclaimed offers, incentives, vouchers, etc beyond the applicable period of the promotional offer.
12. This offer is subject to promotional availability and government regulations.
13. Under this promotion, the Vouchers are being offered directly by Premier Sales Promotions Pvt Ltd. John Distilleries Pvt Ltd is not responsible either directly or indirectly with respect to any matter pertaining to this Voucher and the prize offered with this Voucher.
14. Premier Sales Promotions Pvt Ltd reserves the right to change the terms and conditions of this scheme, including extending, withdrawing, or discontinuing the same without notice, without assigning any reason, at their sole discretion and without any liability.
15. Premier Sales Promotions Pvt Ltd shall not be liable in any manner for any cost or expense incurred for the purpose of redemption of the Voucher.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17. Premier Sales Promotions Pvt Ltd is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
18. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, Premier Sales Promotions Pvt Ltd reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
19. Caution: Any attempt to deliberately damage the Promoter’s promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages, and costs.
20. This voucher has no monetary value, is non-transferable and cannot be used in conjunction with any other promotional offer.
21. Premier Sales Promotions Pvt Ltd or John Distilleries Pvt Ltd will have no legal and financial liability on unclaimed offers, incentives, vouchers, etc beyond the applicable period of the promotional offer.
22. Premier Sales Promotions Pvt Ltd, its clients, agents, and distributors accept no responsibility, financial or otherwise for the misuse of Premier Sales Promotions Pvt Ltd vouchers and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning quality/ availability of featured offers.
23. John Distilleries Pvt Ltd does not endorse the quality of any of the products or services being offered by the Premier Sales Promotions Pvt Ltd or by the cashback partners. Any complaints or queries pertaining to the same would have to be taken up directly with the Premier Sales Promotions Pvt Ltd marketing of such a product or service.
24. Premier Sales Promotions Pvt Ltd, its clients, agents, and distributors cannot replace any lost, stolen or damaged vouchers and reserve the right to withdraw or amend any details and/or prices without notice.
25. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in Bangalore.

29. Lucky Draw Prizes (Non-Monetary Winnings): The promotional activity includes a lucky draw for three winners, who will receive a free resort stay sponsored by John Distilleries Pvt Ltd. JDPL is liable to collect tax at the rate of 30%, plus applicable surcharge and cess (an effective rate of 31.2%). As the prize is non-monetary, JDPL must ensure the winners have paid this tax before releasing the winnings.
30. Lucky Draw Prizes (Non-Monetary Winnings): 
Promotional Hospitality Voucher Terms 
a) Nature of Obligation 
JDPL, as part of its brand promotional and consumer engagement activities, may sponsor and issue hospitality vouchers redeemable at Big Banyan Wines Vineyard or such other partner resorts as may be notified. The issuance of such vouchers is solely for promotional purposes. JDPL shall not, at any time, be construed as being engaged in the business of hospitality, tourism, accommodation or allied services, nor shall JDPL be responsible for providing, managing, supervising, or guaranteeing any stay, service, experience, or facility to the voucher holder. 
b) Voucher Benefits and Inclusions
• Each voucher shall entitle the holder to complimentary entry and a stay for two (2) persons for two (2) nights, along with breakfast, at the designated property specified on the voucher.
• The voucher excludes transportation, transfers, local conveyance, food and beverages (other than breakfast), and any experiential activities or amenities offered by the property.
• Any upgrades, extensions, add-ons, special requests, or chargeable services shall be undertaken solely at the cost and discretion of the voucher holder, and JDPL shall have no responsibility in this regard.
c) Redemption and Booking Process
• The voucher holder shall initiate redemption by sending an email to bigbanyanwines@gmail.com a minimum of 15 (fifteen) days prior to the proposed date of arrival.
• All bookings, confirmations, and allocations shall remain subject to availability at the respective property, and the hospitality provider reserves the right to accept, modify, or deny booking requests in accordance with its internal policies.
• The voucher shall remain valid up to 30th September 2026, after which it shall automatically lapse without any extension, replacement, or monetary compensation.
d) Liability and Indemnity Disclaimer
JDPL’s responsibility is strictly limited to issuing the voucher and ensuring compliance with applicable promotional and tax regulations. Accordingly:
• JDPL shall not be liable for the quality, standard, suitability, safety, availability, or continuity of hospitality services provided by the partner property. Any issues, disputes, claims, deficiencies, or grievances relating to the stay or services shall be addressed exclusively between the voucher holder and the hospitality provider.
• JDPL shall not be liable for any loss, injury, delay, inconvenience, damage, or additional cost incurred by the voucher holder during the travel, stay, or participation in activities at the property.
• The voucher holder agrees to indemnify and keep JDPL harmless from any claims, disputes, or proceedings arising from the redemption or use of the voucher.
e) Tax Deduction and Statutory Compliance
JDPL shall ensure compliance with the applicable provisions of the Income Tax Act, including deduction of tax at source at the rate of 30% plus applicable surcharge and cess (effective 31.2%) on non-monetary winnings or benefits, wherever required, prior to the issuance or handover of the voucher. The voucher shall be released only after completion of all statutory obligations, documentation, and declarations by the beneficiary, as mandated under law.
f) Legal and Regulatory Compliance
• JDPL shall ensure adherence to relevant State Excise laws, rules governing promotional schemes, advertising restrictions applicable to alcoholic beverages, and applicable consumer protection regulations.
• The issuance of hospitality vouchers is a generic promotional activity and shall not, in any manner, be construed as surrogate advertising, inducement to consume alcohol, or a scheme intended to influence purchase/consumption preferences in violation of applicable laws.
